Terms & Conditions

Before launch, the business must verify FoneFlip Ltd’s company details, add any required regulator information, and approve the final shipping carrier/insurance terms and business-specific consumer disclosures. A registered office is not displayed in this draft, in line with the current business preference; the legal reviewer must confirm the final disclosure position.

1. Who we are

FoneFlip Ltd provides a service for obtaining an indicative price for a mobile phone and, where you choose to continue, arranging for that phone to be received, checked and paid for. References to “FoneFlip”, “we”, “us” and “our” mean FoneFlip Ltd.

These terms form part of your agreement with FoneFlip when you use our website, submit a phone request, accept a quote or send us a device. If you do not agree with these terms, do not use the service.

2. Eligibility and ownership

You must be at least 18 years old and able to enter a binding contract. You must be the legal owner of the device or have the owner’s authority to sell it.

You confirm that the device is not stolen, lost, subject to an unresolved finance or hire-purchase agreement, or otherwise encumbered in a way that prevents transfer of ownership. We may suspend or refuse a request or device where we reasonably suspect fraud, theft, blacklist status or an inaccurate ownership declaration.

3. Quotes and requests

A catalogue price, manual price request and quote are estimates based on the model, storage, condition information, market data and other information available when the price is issued. They are not a guarantee that a device will be accepted at that price until it has been checked.

A quote is personal to you and the device described. We may correct a price if the device identity, storage, condition or documentation is incorrect. A revised price is not issued until we notify you and, where required, receive your acceptance.

Unless the quote page states otherwise, a confirmed quote is held for five days from the time it is issued. The expiry time shown on your quote controls. An expired quote may be recalculated at the current available price and may include the expiry adjustment disclosed to you. Expiry does not create an obligation on either side to transact.

You can stop at any point before you send a device. A request for an unlisted phone is a request for review, not an accepted offer.

4. Your information and condition declaration

You must provide accurate information about the device, its storage, network status, condition, functionality and any known damage. You must not conceal material damage, faults, locks or prior repair history that could affect the price or decision to buy the device.

Photos and checklist responses help us assess the device but do not replace our inspection. We may ask for further information before or after the device is received.

5. Shipping and insurance

If you accept a quote, we will provide the available shipping instruction. Keep the device, accessories, SIM tray, packaging and proof of postage until the transaction is complete. Do not send a device before you have received and followed the current instructions.

Shipping risk, liability and insurance limits depend on the option you choose. The exact carrier, price, tracking process, maximum cover and claims procedure must be shown in the shipping instructions before you send the device. If that information is not shown, contact support before sending the device.

You remain responsible for properly packing the device and for the carrier’s acceptance of the parcel. We are responsible for handling the device safely once it is in our possession, subject to the agreed shipping terms and applicable law.

A device may be refused, returned or held for further review if the parcel is unsuitable, materially misdescribed, suspected stolen, or cannot be securely handled. Return charges and responsibility for return postage depend on the reason and will be explained where possible.

6. Inspection, grading and revised offers

We inspect and grade the device against the description and condition tier used for the quote. Checks may include identity, model, storage, network status, activation lock, functionality, screen, body, camera, buttons, charging and other disclosed features.

If the device does not match the quoted description, we may issue a revised offer explaining the reason. You may accept or decline the revised offer. If you decline, we will explain the return process and any applicable return cost. We may close the transaction where a safe, lawful and commercially reasonable return is not possible.

7. Payment

Payment is made by bank transfer to the account details you provide, after the device has been received and the agreed checks are complete. The payment status shown in your account is updated when our team records it. Bank transfer times are controlled by the sending and receiving banks and are not a guaranteed credit time.

You must provide valid account details in your own name or with authority to use them. We may pause payment while identity, ownership, bank-detail or fraud checks are incomplete. We never ask you to send full bank details in an ordinary support email.

We may correct a recorded payment amount where there is an obvious administrative error, with an audit record and notice to you. We do not charge a fee for a correction made by us.

8. Prohibited conduct

You must not use the service fraudulently, attempt to access another person’s account or quote, submit stolen or counterfeit devices, tamper with evidence, scrape or interfere with the service, or use the service in a way that breaks the law or causes harm to FoneFlip, our providers or another person.

9. Cancellation, refunds and returns

You may cancel before sending a device where the service is supplied off-premises, subject to any legal rights that apply and any non-cancellable work already completed. Once a device has been sent, the cancellation and return position depends on the reason for cancellation, the device condition, the work completed and the applicable consumer law.

Where a device is returned, we will use reasonable care and provide the available tracking or delivery information. You are responsible for the condition of the device while it is in your possession after return.

10. Complaints and disputes

If something has gone wrong, contact us with your quote reference and a description of the issue. We will acknowledge the complaint, investigate the relevant record and provide an outcome or next steps. We aim to resolve complaints promptly, but the exact timescale depends on the information and third-party steps needed.

Nothing in these terms limits rights or remedies that cannot lawfully be limited. If you are dissatisfied, you may use an alternative dispute resolution service where available or contact the relevant regulator or ombudsman.

11. Availability, liability and third parties

We may change, suspend or withdraw features where necessary for security, maintenance, legal or operational reasons. We are not liable for losses that were not reasonably foreseeable when these terms were accepted, or that result from events outside our reasonable control, to the fullest extent permitted by law.

Our aggregate liability for claims connected with a device transaction is limited to the amount we agreed to pay for that device, except where a limitation is prohibited by law or the issue concerns fraud, death or personal injury caused by negligence.

12. Changes and contact

We may update these terms. The version and date shown on this page apply to transactions started after that update. Material changes affecting an active transaction will be explained where required.
